Dear Mr. Schrunk,
During a conversation with Chief DA Rod Underhill, on June 19, 2009, he is refusing to prosecute a Misdemeanor Criminal infraction by Civil Servants within the Multnomah County Circuit Court Systems. This is not acceptable and since their actions have harmed me irreparable I insist on prosecution. I have provided Mr. Underhill with evidence and information also sending evidence to the DA May 2009. It has been communicated to me Mr. Jeffrey Hause has these documents. Briefly, Administrator Doug Bray and Clerks Nandy and Brandon, intentionally participated in misconduct by a series of errors they contend occurred because they are so unfamiliar with the ORS 34.10 Writ of Review, Civil Action based 5 key mistakes, never notifying me of these errors, They failed to process case 080912996 leaving in Open Status from Sept. 2008 to November 2008 when I contacted the Court, failed to inform me of EX Parte procedure or the need there of, failed to send a Notice of Appearance to the Plaintiff once the Defendant had been Served. Then, Civil Clerk Brandon contacts the Defendant on June 3, 2009 to inform Ms. Joanna Panza, Legal Assistant Tri-met were not in compliance with Judge Kerr Maurers’ Order to dated February 17, 2009 of the Return by June 5, 2009.
Brandon and Ms. Panza had a conversation which he insured her if she designated her correspondence to him and hand delivered it on June 3, 2009, he would fast track it….This is a direct statement from Brandon ; Ms. Panza stated Brandon called her and provided instructions and information and said he would process it quickly. This is a Misdemeanor as Public Employees Mr.Bray, Nandy and Brandon have used their resources, professional position and influence to impact my rights and complaint severely. I demand my complaint is prosecuted because their actions are a breach of public trust and corrupt in their very being. I believe they have conspired to deny me due process because based on the Law Tri-met would have lost in Court; I have been denied due process by Public Employees whom have subverted their very purpose and professional protocol a Misdemeanor Title 22 241.990 min $25.00 to $1000.00 penalty and 1 year in Jail.
